Nirbhaya Case: Mukesh reached SC to stop the death warrant, critical hearing at 12:30 pm; Hanging on February 1
On December 16, 2016, the Supreme Court will hear the plea of Mukesh, convicted of gang rape in the capital of the country. Mukesh has challenged the President’s order dismissing the mercy petition. I also demanded a moratorium on the death warrant of 1 February. It is another matter that the President’s decision on the mercy petition is considered to be final, despite this Mukesh has filed a petition seeking mercy from the Supreme Court to avoid hanging.
Hearing will be held at 12:30 pm
On the petition of Mukesh, Justice R. The bench of Bhanumathi, Justice Ashok Bhushan and Justice AS Bopanna will hear at 12.30 pm. Mukesh has said in his petition that the President did not consider the mercy petition properly and dismissed it in a hurry. On January 14, the Supreme Court dismissed Mukesh’s curative petition. Also, Vinay’s curative petition was also dismissed. After the curative petition was dismissed, Mukesh sent a mercy petition.
Court said – Hearing will be done on priority basis
On Monday, Mukesh’s lawyer, referring to the petition before the bench of Chief Justice SA Bobde, requested for an early hearing on the case. To this, the bench remarked, “If someone is going to be hanged, nothing could be more important than this. Hanging matters will be given top priority. Mukesh’s petition was included in the Supreme Court’s January 28 agenda that was released later in the evening.
Had a relationship with Nirbhaya in 2012
It may be known that paramedical girl was gang-raped in a moving bus on the night of 16 December 2012 in Delhi. The student was so traumatized that he later died during treatment. In this case, the four accused Mukesh, Pawan Gupta, Akshay Singh and Vinay Kumar Sharma have been given death sentence from the lower court to the Supreme Court.
Death warrant issued, to be hanged at 6 am on February 1
Explain that the reconsideration petition of the four convicts from the Supreme Court has also been rejected. Only then the lower court issued a death warrant against the culprits. The trial court has fixed the time for hanging the four convicts at 6 am on February 1.
Petition has been dismissed on 17 January
The trial court fixed February 1 for the execution of the four convicts, Mukesh, Akshay, Vinay, and Pawan. Mukesh’s mercy petition has been rejected by the President on 17 January. However, the remaining three convicts have not yet filed the mercy petition with the President.
