On Friday, the Delhi government has taken a major decision in the matter related to raising anti-national slogans in Jawaharlal Nehru University. The government has given permission to the Delhi Police to pursue a case of treason against ten other accused including Kanhaiya Kumar, former president of JNU Students Union. The case was pending with the Delhi government for 13 months.
The Special Cell of Delhi Police had investigated the case, but the Delhi government did not give permission on the file to file the chargesheet. After getting permission, Kanhaiya will be tried for treason.
Case filed in fast track court: Kanhaiya
Kanhaiya Kumar has also reacted after being cleared for the treason case. Speaking to news agency ANI, he said that it is clear that the case was made for political gain and it was delayed. I want a trial in a fast-track court so that the entire country knows how a law like treason is being misused. Kanhaiya Kumar said that when the charge sheet was filed for the first time when I was going to contest elections and now Bihar elections are going to be held again.
Anti-country slogans were chanted in JNU
On 9 February 2016, videos of anti-country slogans were revealed in JNU, after which the case was investigated. A case was then filed against Kanhaiya Kumar and others. On January 14, 2019, a chargesheet was filed in the court against 10 people including Kanhaiya Kumar, Umar Khalid, Anirban, Aqib Hussain, Mujib, Umar Gul, Basharat Ali and Khalid Basir in this case of JNU. But the Delhi government did not allow the case to be prosecuted under treason.
The Delhi government had said at the time that the Delhi Police had violated the rules. A charge sheet has been filed without permission from them. Later the Delhi government had said that a legal opinion was being taken in this matter. In the recently concluded Delhi Assembly elections, the BJP had thrown up the matter and tried to surround the Aam Aadmi Party. On which Chief Minister Kejriwal indicated early action in this matter.
Charge sheet was filed without approval from the government
The police got reprimanded many times even before the court for not getting the approval to prosecute Kanhaiya Kumar and others in the JNU sedition case. The police had filed a chargesheet in a court in Patiala House without obtaining approval from the government. Due to this, the court reprimanded the police.
The court has not yet taken cognizance of the chargesheet filed on January 14 last year, as the police were not getting clearance from the government. Repeated hearing on the chargesheet was deferred and every time the police used to have the same answer in the court that the sanction was not granted. The last hearing in this case was held on 19 February. The court had said that write a letter to the government again and take the report in the court by 3 April with the approval.
