43-year-old Vishnu Tiwari, a resident of Uttar Pradesh’s district Lalitpur, spent the last 20 years of his life in Agra jail. He was serving a sentence of rape under the SC / ST Act under rape and atrocities, but Vishnu was acquitted on March 3 after the Allahabad High Court order.

Vishnu Tiwari commuted the crime for 20 years, which he did not commit. After release, Vishnu expressed his pain from the quintet .

Why was he jailed twenty years ago?

Vishnu Tiwari, a resident of Silavan village of Mehrauli police station area of Lalitpur, UP, was accused of raping a woman. It was alleged that she raped a woman from the village when she was going from home to work in the field. The police had registered a case against Vishnu Tiwari under sections 376, 506 of the IPC and sections 3 (1) (7), 3 (2) (5) of the SC / ST Act. Vishnu was arrested on 16 September 2000. At that time Vishnu was 23 years old.

In the year 2003, the Lalitpur court gave the verdict, sentencing Vishnu to 10 years and life imprisonment under SC / ST Act. According to the court’s order, the two sentences were to run concurrently. Under this punishment, Vishnu Tiwari was serving sentence in Agra Central Jail.

“Now we have nothing left”

“A family from the village had registered a case of SC / ST Act and rape against me. We had faith in the judiciary that we will be proved innocent. Thank you lawyer Shweta Rana who fought our case and we were proved innocent. ” – Vishnu Tiwari

Vishnu Tiwari goes on to say, “I was in jail.” Outside, the parents made a last attempt to prove me innocent by selling the land. The parents died of a heart attack, and he left the world. After this, two brothers also died. ”

Recalling the old days, Vishnu said that “We had a happy family, had fields, had engines, had oxen, used to run three plows, had ten buffaloes, but today there is nothing. When I reached home, there was nothing here. ”

“My house is also in ruins.”

Vishnu further told that what he has lost in the last 20 years, he will not be able to get back now, but with the help of administration, he can improve the life ahead. Vishnu said that if the administration supports, then he will be able to build a new house.

Vishnu’s younger brother Mahadev Tiwari also expects compensation from the government. He says that neither the elder brother Vishnu was married nor his due to this lawsuit.

Now, in these circumstances, I expect the government to get a house and land as compensation, so that I can live my life properly by doing business and water, because the one who has passed will not get back and the age of the job is no more. ” – Mahadev Tiwari, elder brother of Vishnu

How did the Allahabad High Court reach the case?

After being sentenced in Lalitpur Court, Vishnu Tiwari was sent to Agra Central Jail, where Vishnu’s brother Mahadev Tiwari went to meet him. Vishnu gave Mahadev the number of Allahabad High Court lawyer Shweta Singh to prove himself innocent.

Mahadev told that he handed over the copy of the sentence given by Lalitpur court to Vishnu to advocate Shweta Singh Rana. They told,

“After seeing the copy of the court, he hoped that my elder brother Vishnu would be left out. The case was held in Allahabad High Court since 2017 and today after being proved innocent my brother has come home. ”

Vishnu Tiwari’s lawyer Shweta Singh Rana said that no evidence was presented in the court under the sections on Vishnu. He further said that the medical report of Victim did not prove that Vishnu is guilty of rape, there was no mention of injury in the report.

The High Court also reprimanded the state on this matter. Rana said that the court said that while instructing the state that such cases, in which the accused has already served more than half the sentence and his trial is pending, such cases should be listed on the record so that cases like Vishnu should be done as soon as possible. Be settled The court said that due to pending, innocent people are getting justice after years, which should be stopped.
